Looking at theRead More planned area from the satellite shot on Google maps, it absolutely screams a definite "No!" intuitively for me. I see no real 'Community' benefit on a daily basis, but rather a lot of construction on minimal and sensitive land that should be preserved for everyone to enjoy.

No. Council has the "authority" to take up any matter it wishes, and to vote on it. E.G., Should the US invade Iraq? Should Kim Kardashian lose weight? Should the oyster farm in Drake's Bay stay open? Should leaf-blowers be banned in Beijing? The question is whether whatever it decides has any significant impact on the quality of life of the residents of the City of Sonoma. Some have phrased the issue not as one of Council's "authority" but whether Council is wasting meeting time on matters it cannot possibly affect or influence, time which might be better spent on matters it can but doesn't want to -- like leaf blowers or wine-tasting rooms on the Plaza -- where the wrong vote could bring out angry crowds carrying torches. On the oyster farm issue, Council had an opportunity to look sympathetic to a distant businessperson hardly anyone in town actually knows who made the very un-businesslike decision to knowingly buy a business whose future depended upon mustering enough political clout in Washington DC to maintain/renew a lease which was due to expire seven years hence and which an Act of Congress gave Secy of Interior Salazar the discretionary power to shut down his business to further Congressional intent under the Wilderness Act. But the only requirement for getting something on Council's agenda is having a friend or friends on Council willing to put it there. There is nothing objectively wrong with that, as long as City business important to local residents who live here eventually gets done in a timely manner. On Monday, Council obviously had nothing more pressing to do. Beyond a small expense stipend, Council is unpaid and staff gets paid no matter what is on the agenda, so local taxpayers suffered no measurable financial harm. It was an opportunity to appear to do something "nice" for the owner and employees of a business that is going to close soon. The US 9th circuit court of appeals which is due to take up the matter and actually decide it will pay no attention to Council's resolution. Its concern will be a bloodless one: Did Interior Sec'y Salazar (not Sonoma City Council) have the authority to make the decision he did? My money is on the Sec'y. Of course, with enough political influence, the oyster farmer may persuade Congress to amend the Act to override the court's decision in time to spare his business. But expect more feel-good items on Council's agenda, for now a clear 5-0 precedent has been set for taking up even more of them. Next month: A resolution banning tornadoes in Oklahoma. Since Oklahoma is mostly populated by Republicans who despise California, expect the vote to be closer.

Far from heckling, it was a response to the evenings format where 95% of the audience was against Plan Bay Area and well aware that this was the last discussion and yet the first where any debate was permitted.==================== At this juncture of transition between Luce and Rubin, Judge Adams reminds us that anyone that is disruptive will be asked to leave. She is setting the stage as Judges and moderators must do to retain control. ========================= Having sat through the entire debate I did not see a single incident where an audience member had to leave the room. Jessica's article gives the impression that the audience was somehow inappropriate. In my experience the person who was most inappropriate was Supervisor Kinsey whose snarky comments and constant reminder to the audience that he was upset because too few people supported Plan Bay Area and he wasn't going to be able to change minds.============== In a recent Dick Spotswood column he talks about what makes a Supervisor good at his job and he describes the ways in which Hal Brown made the job about the people he served and their visions for Marin rather than his own. While reading Spotswood's column I became aware of how far afield Supervisor Kinsey is of this kind of behavior.==================== Kinsey made clear throughout the debate that if you weren't for his agenda then you were against him. He acted as if the complaints leveled at Plan Bay Area were personal attacks and he seemed to be indifferent to constituents that didn't share his viewpoints. Luce was more apologetic. Clearly his stand was one in which he didn't want Napa to get sued again. Please note it was sued by Public Advocates and two other non profits. There is certainly a way to care for the environment and live nearer nature.
